Abstract :

This study aims to analyze the reality of intellectual property rights in Libyan media legislation, through a study of the laws related to trademarks, intellectual property, patents and the deposit of works . The researcher focused on analyzing their effectiveness in protecting cultural .and media production

adopted a descriptive-analytical approach, using a content analysis tool applied to a set of laws related to intellectual property. By analyzing the content of the legal texts, the results revealed that Current legislative texts suffer from a lack of precision in concepts and definitions, which opens the door to interpretation and multiple applications. This ambiguity may lead to inconsistencies in the application of the law among executive bodies, negatively impacting legal justice.  The results also showed that the penalties regulating intellectual property are characterized by legal strictness and an imbalance between deterrence and incentive. They are strong in the area of penalties and deterrence, but weak in the regulatory, educational and awareness aspects that encourage creativity.

recommended the need to update legislation to keep pace with digital transformations, and to promote legal culture in media institutions to protect intellectual and creative production .
